Terms of Service

These terms apply when you hire Valley Digital to design, build, host, or look after a website. Hiring us means you agree to them.

What we do

We design and build a custom website for your business, register or connect your domain, host the site, keep it secure and online, and make ongoing content updates as described in your package. Anything outside that scope is quoted separately before we start.

Pricing and payment

What we need from you

To build your site we need your business information, and often photos, logos, and copy. By sending us material you confirm you have the right to use it. We cannot use images or text you do not own the rights to, and we are not responsible for material you supply that infringes someone else's rights.

Projects stall most often because we are waiting on content. The 48 hour turnaround starts once we have what we need.

Revisions and approval

We work with you until the site is right before it goes live. After launch, your package includes a set number of content updates each month. Larger changes such as new page templates, a redesign, or new functionality are quoted separately.

Who owns what

Cancelling

There is no contract and no minimum term. Cancel any time by telling us. Hosting continues to the end of the month you have paid for. We will help you move your domain wherever you want it. Setup fees already paid are not refunded, since the work has been done.

Uptime and support

We monitor uptime and aim to keep your site online continuously, but we do not guarantee uninterrupted service. Hosting, domain registration, and network providers occasionally have outages outside our control. If something breaks, tell us and we will fix it as quickly as we can.

Acceptable use

We will not host content that is unlawful, fraudulent, or designed to deceive people. If a site we host is being used that way, we may suspend it.

Search rankings

We build sites to be found: clean structure, fast loading, proper markup, and local SEO groundwork. Nobody can guarantee a particular position in Google, and we do not.

Liability

We do our best work, but services are provided as is. To the extent the law allows, our total liability for any claim relating to our services is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential losses such as lost profits.

Governing law

These terms are governed by the laws of the State of California, and any dispute belongs in the courts of Riverside County, California.

Changes

If these terms change we will update the date at the top of this page. Material changes affecting existing clients will be sent to you directly.
